Summary:
The purpose of the Iraq Compliance Officer position is to assist in exercising oversight responsibility in implementing HAI/HA’s compliance and ethics program in HAI Iraq to detect, resolve, mitigate and prevent violations. The position will also promote ethical practices and a commitment to compliance with company and program requirements, as well as local and U.S. law. The Iraq Compliance Officer assists HAI HQ senior management in ensuring the faithful implementation of the compliance and ethics program as directed by the HAI/HA Enterprise Risk Management (ERM) team. This position reports directly to the HAI HQ Compliance Manager and has a dotted line to the Iraq Country Director to ensure oversight and integration of the position into the Iraqi Office operations.
Roles & Responsibilities:
Compliance Policies and Procedures Development, Review, Implementation and Management:
- Assists Iraq Country Director, HAI HQ senior management and HA ERM in the development, review, implementation and management of HAI/HI compliance and ethics policies, procedures related to the HAI/HA compliance and ethics program.
- Works with Iraq Program and Project staff to ensure compliance with relevant policies and procedures and donor rules and regulations.
Internal Monitoring and Compliance Risk Assessments
- Prepares annual Risk Assessment Monitoring Plan for operations (finance, human resources, etc.) and grant/subgrant compliance, to identify areas/instances of non-compliance with HAI/HA compliance and ethics policies and procedures; working with HAI Iraq and HAI HQ senior management to address and resolve gaps, weaknesses and errors; and develops recommendations to resolve and mitigate them in the short-term and long-term.
- Conducts internal risk assessments and compliance reviews for Iraq programs in collaboration with HAI Iraq and HQ senior management, using various assessment tools developed to identify and assess compliance issues.
- Works with Iraq staff and HQ Compliance Manager to evaluate assessments and review findings, develop and issue corrective actions and to monitor resolution and future mitigation procedures.
- Reports on compliance matters in providing internal monthly monitoring report to Iraq Country Director, HAI HQ Compliance Manager, HQ Controller and ERM.
- Immediately escalates any high-risk, fraud, abuse, and/or safety and security matters to Iraq and HQ senior management.
- Assists HQ Compliance Manager and Iraq staff in preparing, updating and maintaining due diligence tools and procedures to conduct vendor/partner/grantee assessments prior to entering into an agreement.
- Assists in conducting due diligence reviews and risk assessments for vendors/partners/grantees, developing a corrective/mitigation plan and monitoring performance to ensure compliance.
- Works with Iraq Country Director and HQ staff to prepare a corrective action plan to potential financial or reputational impact on Iraq’s Program.
- Assists in conducting HQ-led Iraq internal audit missions, in accordance with the approved HQ Country Compliance Response Plan, and HAI internal audit procedures and requirements.
- Participates in annual HAI Compliance Risk Assessment.
Internal Investigations
- In collaboration with HQ, implements and manages internal investigation protocols for the Iraq office.
- With HQ oversight, serves as the Iraq Office lead in investigating compliance and ethics issues, as defined in HAI/HA policies and procedures, to include fraud, waste, abuse, award/subaward noncompliance, and inappropriate use of company resources.
- Prepares ‘complete and concise’ investigation reports, conducts or oversees post-investigation tasks and shares with relevant HQ and Iraq Office staff to determine next steps and actions.
- Conducts post-investigation reviews and/or staff surveys to monitor retaliation safeguards and effectiveness of speak up culture.
- Works and coordinates with Iraq Office relevant staff and HQ staff to prepare responses to donors/funders, when applicable.
- Provides data on trends to management and HQ.
Training and Capacity Building
- With HAI Iraq and HQ management, develops a learning management plan for compliance, ethics and conflict of interest training.
- In collaboration with HQ, delivers the training to HAI Iraq employees to ensure their awareness, understanding and compliance with compliance and ethics policies and procedures and all relevant rules and regulations.
- Assists in monitoring, compiling and disseminating new and updated compliance and ethics information through regular communications with Iraq staff.
External Audits and Monitoring Reviews
- Participates in the preparation for external audits and due diligences in close collaboration with the relevant local staff (Finance team, Administration & Operations, Procurement) and relevant HQ staff (Controller, Finance, HQ Compliance Manager and ERM, when applicable) as instructed.
- Upon request, assists with the facilitation of donor audits as determined and assigned during audit planning meetings.
- Supports and contributes to implementing partner and grantee compliance desk reviews, when applicable.
- Upon request, participates in internal kick-off and post audit meetings to share lessons learned from previous and completed audits to integrate any new practices, procedures in the external audit process.
- Reviews partner documentation on monthly basis and reports on any deviations.

Qualifications & Preferred Skills
- Language fluency and command of Kurdish/Arabic and English (spoken and written)
- At least 4 years of related compliance experience: NGO and U.S. federal government compliance experience is a plus
- Ability to be a strong team player but also work independently, determine priorities, and successfully work in accordance with specific timelines and deadlines
- Knowledge and understanding of the local labor and other relevant in-country laws
- Knowledge and understanding of U.S. federal government compliance rules and regulations
- Demonstrable high level of interpersonal skills, diplomacy and patience
- Excellent critical thinking skills, solutions-oriented and accurate attention to detail
- Impartiality, objectivity and confidentiality.
- Excellent computer skills in Microsoft Word, Microsoft Excel; QuickBooks a plus
Ability to travel locally, when necessary
- Demonstrable prior experience utilizing critical thinking and problem-solving skills to help resolve high risk / sensitive issues effectively and efficiently.
